CORAM:
JUSTICE BISWANATH RATH
ORDER
03.03.2022 Order No.
01.
1.
This petition involves the following relief:
"Relief sought for :
It is therefore, prayed that this Hon'ble Court/Tribunal may graciously be pleased to admit the original application and after hearing the parties pass the following reliefs :
(i) Let the impugned order communicated vide Memo No.12548 of dated 31.08.2013 under Annexure-10.
(ii) Let the applicant be allowed to continue in his present division under Respondent No.4;
(iii) Let, any other relief / reliefs be passed to which the applicant entitled to;"
2.
Looking to the prayer made in this petition and the impugned order involved herein, this Court finds, there is no dispute at Bar that by order dated 16.09.2013 the Petitioner claims, there has
// 2 // been protection to him and also contended that by virtue of the impugned order, he is still continuing as Watchman. 3.
Considering that much water has already flown in the meantime and as almost 9(nine) years have already passed in the meantime in the continuance of the impugned order, the impugned has lost its force. Accordingly, this Court in disposal of the present petition observes, provided there is no otherwise development in the meantime, there may be fresh consideration of the reversion issue involving the Petitioner by the competent authority. 4.
The application thus stands disposed of.
(Biswanath Rath) Judge Ayaskanta Jena
