1. This matter is taken up through hybrid mode. Order No.

2. Heard Mr. R.N.Mohanty, learned counsel for the Petitioner and Mr. S.K.Mishra, learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 17th August, 2021 in connection with Chandrasekharpur P.S. Case No.366/2021 corresponding to T.R. Case No.368/2021 pending in the court of learned Special Judge, NDPS-cum-Sessions Judge, Khurda

// 2 // at Bhubaneswar for the alleged commission of the offence under Sections 29/21(C) of NDPS Act

4. Considering the submissions made, the materials on record, the period of detention already undergone and the fact that no contraband was seized from the possession of the Petitioner but he was implicated entirely on the basis of the statement of the co-accused, I am inclined to allow the prayer for bail.

5. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before I.I.C., Chandrasekharpur P.S. on every Monday at 10.0 A.M. for a period of six months.

6. The BLAPL is disposed of.

7. Urgent certified copy of this order be granted on proper application.
