This matter is taken up through hybrid mode.

None appears for the petitioner when the matter is called. On 21.03.2022 none had appeared for the petitioner and after considering the matter in some detail and hearing the learned Standing Counsel for the State, the following order was passed:

The writ petition has been renumbered and registered before this Court on 04.12.2021 after being transferred, upon abolition of Odisha Administrative Tribunal, Cuttack.

On perusal of the available order-sheets of the learned Tribunal, it is indicated that the notices were issued on 17.05.2013 and thereafter the matter was never taken up before this Court.

The original application was filed in the year 2013 by the petitioner, who was aged about 52 years working as Child Development Project Officer in Kalampur I.C.D.S. Project, Kalampur in the district of Kalahandi, challenging promotions of opposite party nos.6 to 8 by the Government, Department of Women and Child Development vide order dated 16.01.2013 on the ground that the

// 2 // petitioner is senior to the persons, who got promotions.

It is submitted by the learned Standing Counsel that in view of the grievance raised in the original application regarding grant of promotion and consequential seniority, nothing would survive after a lapse of about nine years from filing of the petition, which was never pursued and for the fact that the rights of the opposite party nos. 6 to 8 would have crystallized and further the petitioner would have retired in the meantime, on attaining age of superannuation in the year about 2021. 7.

Having heard the learned counsel for the opp. Parties-State to grant another opportunity to the petitioner, list this matter on 12.04.2022."

The learned Standing Counsel reiterates his submission on behalf of the State as noted in the order dated 21.03.2022. The writ petition is dismissed for non-prosecution. ( M.S.Sahoo) Judge Gs
