1. Learned counsel for the Petitioner being present submits that in view of the plea taken by the State in paragraph 5 of the counter affidavit, since the petitioner is continuing in his present place of posting, nothing remains in the petition for this court for a direction. Paragraph-5 reads as under:

Para- 5 - That it is humbly submitted that pursuant to the order dated 16.08.2017 of termination and in view of the orders passed by this Hon'ble Court, the Petitioner has been transferred to Padmapur Ashram School, boys Ashram School and he is continuing as a cook in the said school till today. It is humbly submitted that the Petitioner has been continuing as a cook in the Boys Ashram School and no further action will be taken against the Petitioner based on the impugned order dated 16.08.2017 of disengagement . Thus, in view of the same, no further cause of action survives in the present petition. It is also pertinent to note that the Petitioner's transfer to Boys Ashram School is in

// 2 // line with the order dated 05.01.2018 passed by the Learned OAT which directed the Opposite Party to enquire as to whether any decision has been taken for rehabilitation of the Petitioner."

2. In view of the above submissions and admission of the state as to the present status of the Petitioner, the WPC (OA) stands disposed of.
