None appears for the Petitioner at the time of Call. Heard Mr. S. Rath, learned Additional Standing Counsel for the State. Perused the record.

The Petitioner has filed this Writ Petition seeking direction to the Opposite Parties to consider the past service period from 21.09.2000 to 28.07.2002 and pay arrears as due and admission along with other dues. 4.

A counter affidavit has already been filed by the Opposite Parties 1 and 2, wherein it has been stated that action has already been taken by this Department for regularization of his service period from 20.09.2000 to 28.7.2002 by sanctioning the said period as Leave due and admissible and the BDO, Kanas Block has been requested vide this Department letter No.12743 dated 7.7.2018 to furnish the leave proposal of Sri Sahoo in the prescribed OGFR format as per Odisha Leave Rules,1966 to this Department for necessary sanction and soon after receipt of the same, leave will be sanctioned in favour of Sri Sahoo and thereafter his final pension papers will be sent to AG (A&E), Odisha, Bhubaneswar for sanction of his final pensionary benefits. However, learned Additional Standing Counsel further contended that since the affidavit has been filed

in the year 2018, he has no further instruction in this matter. 5.

In view of the above statements made in the Counter Affidavit, the Writ Petition stands disposed of giving liberty to the petitioner to move the appropriate authority, if any cause of action still subsists. Arun (DR. B.R. SARANGI) JUDGE
