As the Petitioner No.2 has in the meantime been arrested; learned counsel for the Petitioner does not want to press this application insofar as the said Petitioner is concerned. Accordingly, now the petition stands confined to Petitioner No.1 (hereinafter referred to as 'the Petitioner'). 4.

Heard learned counsel for the Petitioner and learned counsel for the State.

In view of the bar contained under sub-section 4 of section 438, Cr.P.C., the application stands disposed of with the observation that in the event the Petitioner surrenders before the learned court in seisin of the case in connection with Harabhanga P.S. Case No.129 of 2020 corresponding to C.T. No.672 of 2020 pending in the court of the learned District & Sessions Judge-cum-Special Judge, Boudh and moves for his

// 2 // release on bail, the same shall be considered on its own merit as per law and disposed of early in accordance with law without being influenced by this order.
