This matter is taken up through virtual/physical mode. 2.
The Original Application No.2718 (C) of 2013 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as W.P.C.(OAC) No.2718 of 2013.

Heard Sandip Rath, learned counsel on behalf of Mr. Sadasiv Patra, learned counsel for the Petitioner and Mr. Manoj Kumar Khuntia, learned Additional Government Advocate for the State-Opposite Parties.

The Petitioner-Applicant questions the inaction of the Opposite Parties in not according promotion to the post of Statistical Investigator, the Petitioner claims such promotion due since 2009, i.e. prior to his superannuation on 31st March, 2011.

Learned counsel submits that the Petitioner had made representations to Opposite Party No.2-Director of Economics & Statistics, Odisha (Annexures-2, 3 and 4). Conceded by
// 2 // both the counsels for the parties that said representations have not been attained its finality as yet.

Considering the aforesaid submissions, it would be deemed proper to direct Opposite Party No.2-Director of Economics & Statistics, Odisha to consider the representations of the Petitioner, if not already disposed of. 7.
The Petitioner is required to approach Opposite Party No.2-Director of Economics & Statistics, Odisha and produce the certified copy of this order along with copies of representations (Annexures-2, 3 and 4) within two weeks. The Opposite Party No.2 will consider the said representations, if pending, within a period of three months thereafter in accordance with law.

With the aforesaid observation, this petition is disposed of.
