Petitioner Mr. G.P. Jena, Advocate -versusState of Odisha and Others ...
Opposite Parties Mr. Ishwar Mohanty, Addl. Standing Counsel
CORAM:
THE CHIEF JUSTICE JUSTICE R.K. PATTANAIK Order No.
ORDER
08.08.2022 02.
1. There is only submission made by learned counsel for the Petitioner, is, that the punishment of withholding of two increments with cumulative effect for unauthorized absence is disproportionate.
2. In the present case, the unauthorized absence was for a period of six months from 14th September, 2006 till 8th March, 2007. This long period of six months was without any prior permission or even getting the approval of the competent authority.
3. Consequently, the Court is not persuaded that the punishment awarded for such unauthorized absence for nearly six months is disproportionate and requires any modification. The writ petition is accordingly dismissed.
(Dr. S. Muralidhar) Chief Justice (R.K. Pattanaik) Judge S.K. Jena/Secy.
