Petitioner A.K. Chhatoi, Advocate -versusState of Odisha & Another ....
Opposite Parties Mr. P.K. Mohanty, ASC
CORAM:
JUSTICE M.S. RAMAN
ORDER
02.09.2022 Order No.
07.
1.
This matter is taken up through virtual/physical mode. 2.
The Original Application No. 1829 of 2017 was filed before the State Administrative Tribunal, Bhubaneswar. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OA) No. 1829 of 2017.
3.
On the plea of the pendency of disciplinary proceeding against the Petitioner, Joint Secretary in Finance Department is denied to the promotion for the rank of Additional Secretary. The Petitioner has pleaded that 24 juniors have already been promoted by the time the present petition has come to be filed. It is alleged by the Petitioner that though the Government of Odisha in General Administration Department issued instruction fixing time limit for conclusion of disciplinary proceeding, non-adherence to such instruction compelled the Petitioner to approach this Court for issue of mandamus.
4.
At the time of hearing today, Mr. A.K. Chhatoi, counsel for the Petitioner submitted that during the pendency of the case, the matter has been rendered infructuous.
// 2 // 5.
In view of such submission the writ petition is disposed of as infructuous.
