IN THE HIGH COURT OF ORISSA AT CUTTACK

CMP No.647 of 2021 Gurubari Dehury .....

Petitioner Mr.B.B.Mishra, Advocate - VersusRangalata Mahakud .....

Opposite parties

CORAM:

JUSTICE BISWANATH RATH

ORDER

04.01.2022 Order No.

1.

Heard Mr. Mishra, learned counsel appearing for the petitioner.

2.

Undisputedly for the Hon'ble Apex Court decision, the impugned order/interim order stands automatically vacated on expiry of six months, for his own submission, Mr.Mishra, learned counsel for the petitioner that even though he has filed an application for continuance of stay order, the same has not been taken up as of now. In the above circumstance and for the discussion in the impugned order, this Court finds there is no wrong in the impugned order requiring to be interfered with. This Court further also observes looking to the stage of the suit, in absence of a challenge to the preliminary decree, there is no wrong in the reasoning of the impugned order. This Court, therefore, declines to interfere in the impugned order. Consequently, the CMP stands dismissed.
