Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. 3.

The petitioner is an accused in Special Case No.251 of 2020, on the files of learned Court of Special Judge, Balasore, arising out of Jaleswar P.S. Case No.306 of 2020, under Sections 376 of IPC read with Section 6 of the POCSO Act and is in custody since 14.09.2020.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge, Balasore, by order dated 21.09.2020 in the aforementioned case, the present BLAPL has been filed.

Considering the 164 Cr.P.C. Statement and medical examination Report and the period of custody of the petitioner, this Court directs the petitioner to be released on bail on such terms to

be fixed by the learned Court in seisin over the matter, so as to ensure the presence of the petitioner on each date of trial. 6.

Accordingly, the BLAPL stands disposed of.
