This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner and learned Additional Standing Counsel for the State. Perused the Original Application.

The present writ petition has been filed by the Petitioner with a prayer to direct the Opposite Parties to grant /sanction the family pension and release of the retiral benefits of her late husband within a stipulated period.

It is further submitted by learned counsel for the Petitioner that she has submitted a representation to the Secretary, Health and Family Welfare Department, Govt. of Odisha, Bhubaneswar, Opposite Party No.1, unfortunately no decision has been taken on the said representation of the Petitioner till date. 5.

Learned counsel for the State submits that it not known whether the representation of the Petitioner has been still pending

// 2 // before the Authority or not? However, he submits that in the event Petitioner files a fresh representation before the Appropriate Authority, the same shall be considered within a stipulated period of time strictly in accordance with law.

Having heard leaned counsel for the Petitioner and keeping in view the fact that the matter is pending since the year 2012, this Court in the interest of justice feels it appropriate to direct the Petitioner to file a fresh representation before the Secretary to Govt. of Orissa, Health & Family Welfare Department, Opposite Party No.1 within a period of two weeks from today along with certified copy of this order, the same shall be considered and disposed of by the Opposite Party No.1 strictly in accordance with law within a period of two months thereafter by passing a reasoned and speaking order thereon. The decision so taken on the representation shall be communicated to the Petitioner within ten days thereafter. 7.

With the above direction, the writ petition stands disposed of.
