This matter is taken up through hybrid mode.
RJ 2.
No one had appeared, when the matter was taken up on 23.03.2022. Today also none appears for the petitioner, when the matter is called.

On 23.03.2022, after considering the matter in some detail and submissions of the learned Standing Counsel, the following order was passed:- "The writ petition has been registered before this Court on 6th December, 2021, after the original application was transferred from the learned Orissa Administrative Tribunal, Cuttack Bench, Cuttack upon its abolition.

On perusal of the available order sheets of the learned Tribunal, it is indicated that the matter was never taken up after 05.11.2014.

None appears for the petitioner, when the matter is called.

The original application was filed in the year 2013 when the applicant/petitioner was aged about 46 years, working as Teacher in Lalita Dei
// 2 // Pur Sasan Upgraded High School, challenging the order passed by the District Project Coordinator, RTE, SSA, Nabarangpur (Annexure-9) dismissing the petitioner from service as a Teacher w.e.f. 23.07.2013.

It is submitted by the learned Standing Counsel (School and Mass Education Department) as the order of dismissal was given effect to immediately, nothing would survive after nine years and for the fact that the matter was never pursued before the learned Tribunal for the last nine years. 6.
It is submitted by the learned Standing Counsel for the State-opposite parties that since the matter has been transferred from the learned Tribunal, he does not have copy of the writ petition and may be accommodated to obtain copy of the same.

To grant another opportunity to the petitioner, list on 18th April, 2022."

Learned Standing Counsel reiterates the submissions on behalf of the State as noted in the order dated 23.03.2022.

Having heard learned Standing Counsel, the writ petition is dismissed for non-prosecution.
