Petitioner in this RPFAM seeks to assail the order dated 16th August, 2022 (Annexure-3) passed by learned Judge, Family Court, Balasore in Cr.P Execution Case No.20 of 2022 whereby it is directed to recover the arrear maintenance of Rs.4,50,000/- in thirty monthly instalments by recovering Rs.15,000/- per month from the salary of the Petitioner. 3.

Mr. Sethy, learned counsel for the Petitioner submits that recovery of Rs.15,000/- per month is too harsh because the gross salary of the Petitioner is Rs.36,264/- per month. He, however, submits interest of justice will be best served if the Petitioner moves an application for reconsideration of amount of recovery from his salary. Thus, he prays for withdrawal of the RPFAM to enable the Petitioner to move such an application before learned Judge, Family Court, Balasore. 4.

In view of such submission, the RPFAM is disposed of as withdrawn.
