This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

The writ petition involves the following prayer: "(i) The Hon'ble Tribunal be pleased to direct the Respondents to sanction and disburse the 2nd stage ACP benefit w.e.f. 1.1.2006 & 3rd stage ACP benefit w.e.f. 01.08.2009 in favour of the applicant as per the ORSP Rule, 2008 notwithstanding any changing of post although it does not amounts to any change of scale of pay & benefit within a time bound period for the interest of justice.

(ii) The Hon'ble Tribunal may be pleased to pass any order(s)/direction(s) as deems fit and proper for the interest of justice."

With the passage of time, the matter has become infructuous in the meantime. However, it is submitted by learned counsel for the Petitioner that he will file a fresh representation before the Authority

// 2 // concerned stating therein the claims and benefits he is entitled to as per law.

In the event a representation is filed within a period of four weeks hence, the Authority shall consider the same within a period of 10 (Ten) weeks thereafter in accordance with law and dispose of the same by passing a reasoned and speaking order. Result thereof also be communicated to the Petitioner within ten days thereafter. 5.

With the above direction, the writ petition stands disposed of.

Issue urgent certified copy as per rules.
