1. 1. This matter is taken up through Hybrid Mode. Order No

2. Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

3. The Petitioner has filed the present Writ Petition for the following reliefs.

"Under the above circumstances, it is humbly prayed that this Hon'ble Tribunal may graciously be pleased to admit this application, issue notice to the Respondents and after hearing them be further pleased to direct the Respondents appoint on compassionate ground being the dependent of the deceased employee as per the prevalent rules and Laws on the date of application;

And any other order/orders or directions/directions be issued so as to give complete relief to the applicant."

4. Although notice has been issued since 25.6.2015, but no counter has been filed by the State-Opposite Parties.

5. Taking into account the claim raised in the present Writ Petition, liberty is granted to the Petitioner to make a detailed representation before Circle Inspector of School-Opp. Party No.3(at present DEO, Gajapati) by enclosing all the relevant documents and citations in support of his claim, if any, within a period of four weeks hence.

It is observed that if such a representation is filed within the aforesaid period, Circle Inspector of School-Opp. Party No.3(at present DEO, Gajapati) shall do well to take a lawful decision within a period of three months from the date of receipt of such representation. The order so passed by the Opp. Party No.3 be communicated to the petitioner.

7. However, the petitioner is at liberty to challenge the order passed by Opp. Party No.3.

8. With the aforesaid observation and direction the Writ Petition is disposed of.
