The Original Application No. 387 of 2011 was filed before the State Administrative Tribunal, Bhubaneswar. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OA) No. 387 of 2011.

The Petitioner claimed to have entered into Government service earlier to the Opposite Party Nos. 3 & 4, Bhaskar Chandra Behera, Superintendent Level-II and Manjulata Ranasingh, Superintendent Level-II. Though said Opposite Parties belonging to reserved category were given accelerated promotion, while finalizing the gradation list, in view of catch up principle, the Petitioner should have been given due seniority in the said promotional cadre. 3.
A counter has come to be filed by the Opposite Party Nos. 1 &2, relying on which it is submitted that the gradation list was prepared keeping in view the position law prevailing at the relevant point of time. So the grievance of the Petitioner is unfounded.

Ms. Nandita Patra, proxy counsel appearing on behalf of Mr. P.K. Mahapatra, counsel for the Petitioner submitted that she has no instruction.

In view of the aforesaid position, no indulgence need be shown at this distance of time. Accordingly, the writ petition is dismissed.
