Heard Mr. Nanda, learned Additional Government Advocate for the State-Opposite Parties.

Mr. Nanda, learned Additional Government Advocate draws attention of this Court to the order dated 30th June, 2013 passed by the Odisha Administrative Tribunal, Cuttack Bench, Cuttack, relevant portion of which reads as follows: "As regards prayer for interim order, 'status quo' as on date in respect of the applicant be maintained till disposal of this O.A. as Rule 58 of the OCS (Pension) Rules, 1992 itself prescribes preparation of pension papers two years prior to his date of retirement."

In view of the above, it seems that the Petitioner has got superannuated from service in the meantime. The cause of action does not survive and the writ petition has been rendered infructuous by efflux of time.

Accordingly, this writ petition is disposed of as infructuous.
