Heard learned counsel appearing for the petitioner. 2.

For the concurrent finding of fact, this Court finds no scope for interfering in the matter of injunction after the petitioner loses in both the forums. In the circumstance, while declining to interfere in the impugned order, this Court targets the suit which is pending since 2014. Consequently, this Court directs the Civil Judge (Senior Division), Bhadrak, to conclude the. C.S.No. 369 of 2014-1, as expeditiously as possible, preferably within a period of nine months from the date of communication of certified copy of this order by the petitioner. This Court records the undertaking of the counsel for the plaintiff that there shall be no unnecessary adjournment in the finality of the suit proceeding.

The CMP stands disposed of with the observation and direction made hereinabove.
