1. Heard learned counsel for the Petitioner and the State.

2. This is an application for bail U/s.438 Cr.P.C. filed by the Petitioner in anticipation of arrest for his alleged involvement in the offences U/s.294/506/379/353/34 IPC read with Sections 181/185/196 of the M.V. Act.

3. Learned counsel for the Petitioner, inter alia, submits that he is ready to deposit the fine imposed under the various provisions of the M.V. Act alleged against him to the tune of Rs.17,000/-. He is further submitted that the user of the vehicle i.e. the Petitioner had never intended to though the action of the public servant while discharging his duty and that a false allegation has been made against him.

4. Learned counsel for the State, on the contrary, submitted that no criminal antecedent stands to the credit of the present Petitioner.

Having regard to the fact that the Petitioner is ready to deposit the fine amount valued at Rs.17,000/-, the facts and circumstances, the seriousness and gravity of the offences, while this Court is not inclined to grant anticipatory bail, it is directed that in the event the Petitioner surrenders in connection with Jharsuguda P.S. Case No.628 of 2022 corresponding to C.T. Case No.2907 of 2022 pending in the court of learned S.D.J.M., Jharsuguda within a period of two weeks' hence and moves for bail, he shall be released on such terms and conditions as would be deemed just and proper by the said court with further conditions that he shall appear in person before the court below on each date of posting of the case unless specifically exempted by the court concerned with the further conditions he shall furnish the proof of payment of find to the tune of Rs.17,000/- as has been undertaken by the present Petitioner.
