This matter is taken up through hybrid mode.

RJ 2.

When the matter was last taken up on 04.03.2022 by a coordinate Bench of this Court, the following order was passed:- "2. The Original Application No.2878 (C) of was fled before the Orissa Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as W.P.C.(OAC) No.2878 of 2013.

3. Heard Mr. Panda, learned counsel for the petitioner and Mr. Pattnaik, learned Standing Counsel for the School and Mass Education.

4. On perusal of the order sheets available in this record, it is revealed that orders have been passed by the Odisha Administrative Tribunal, Cuttack Bench, Cuttack in OA No.2873(C) of 2013, which are made applicable to this case.

5. It is submitted at the bar that said OA along with batch of cases have been disposed of by this Court.

6. Mr. Panda, learned counsel for the petitioner seeks one week time for production

// 2 // of copy of the order passed by this Court in said batch matters.

7. List this matter one week after."

Learned counsel for the petitioner submits that he has not been able to contact the petitioner and further submits that there is no instruction to pursue the matter on behalf of the petitioner at present. 4.

The memo filed by the learned counsel for the petitioner is taken on record.

Learned counsel for the petitioner submits that the petitioner may be granted liberty for any surviving cause of action and the matter may be disposed of. 6.

Learned Standing Counsel for the School and Mass Education Department submits that considering the nature of grievance raised in the writ petition, nothing would survive at present for adjudication before this Court.

Having heard learned counsel for the parties, the writ petition is disposed of for lack of up-to-date instruction from the petitioner to pursue the matter at present.

Accordingly, the writ petition is disposed of granting liberty to the petitioner to revive the petition within sixty days for any surviving cause of action. (M.S. Sahoo) Judge
