This matter is taken up through hybrid mode.

The writ petition has been registered before this Court on 2nd December,2021 after being transferred from the learned State Administrative Tribunal, Cuttack Bench, Cuttack.

On perusal of the available order-sheets of the learned Tribunal, it is found that the matter was never listed after 12.10.2012.

Learned counsel for the petitioner submits that at present he does not have any instruction. The Original Application was filed challenging the order dated 04.04.2012 under Annexure-4 directing the petitioner to go for training to be promoted as Lance Naik in OSAP Battalion, while the petitioner was working as Sepoy.

// 2 // Learned counsel for the petitioner submits that the petitioner may be permitted to withdraw the present writ petition with liberty to pursue his remedy in accordance with law for any surviving cause of action.

The writ petition is accordingly disposed of granting liberty as prayed for.
