The petitioner has filed this writ petition seeking to quash the letter dated 29.08.2012 passed by opposite party no.3 under Annexure-6, and to issue direction to the opposite parties to consider his case under rehabilitation assistance rules.

Having heard learned counsel for the petitioner and after going through the records, this Court finds that since the death has been occurred on 17.02.2008 and the petitioner had submitted the application on 21.08.2012 under Annexure-5, the order in question in Annexure-6 passed by the authority is justified stating therein that Rules-9(6) of OCS, 1990 has not been complied with, meaning thereby the petitioner has not applied for compassionate appointment within the period of one year. 4.
In such view of the matter, the claim of the petitioner is hit by the limitation prescribed under Rules-9(6) of OCS, 1990. Consequentially, this Court is not inclined to entertain this writ petition at this stage. 5.
