2. Heard Mr. J.K. Khuntia, learned counsel for the Petitioner and Mr. P. Bharadwaj, learned counsel for the State.

3. The Petitioner has filed the present Writ Petition with the following prayer:- "i) The Hon'ble Tribunal may graciously be pleased to allow this application and direct the Respondents to consider the case of the applicant for promotion to the post of the Junior Clerk under 10% reserve category from Group-D employees after holding D.P.C. with all consequential benefits from the date of eligible and further direction may kindly be issued to the Respondent No.3 not to fill up 10% Junior Clerk Posts in pursuance of the Advertisement under Annexure:-11 till disposal of the Original Application.

// 2 // ii) And pass any other order/orders, direction/directions as this Hon'ble Tribunal may deem fit and proper;

iii) And allow this Original Application with Cost."

4. Since no counter affidavit has been filed in spite of service of notice and for the self same relief, the Petitioner has made an application before Opposite Party No.3, vide Annexure-12, I propose to dispose of the writ Petition.

5. Accordingly, this writ Petition is disposed of with a direction to Opposite Party No.3 to take a lawful decision on Annexure-12 taking into account the resolution vide Annexure-9 to the writ Petition within a period of three months from the date of receipt of the certified copy of the order along with the copy of the representation under Annexure-12 and the aforesaid Resolution. The order so passed by the Opp. Party No.3 be communicated to the Petitioner also.

6. With the aforesaid observation and direction, the Writ Petition is disposed of.
