1.This matter is taken up by hybrid mode.

2. Heard.

3. The petitioner has filed the Original Application before the Odisha Administrative Tribunal which has been transferred to this Court.

4. Learned counsel for the petitioner submits that the petitioner belongs to S.T. category. He was working as Peon in the office of the District Treasury Office, Bargarh since 10.02.1981. In the meantime he had served for more than 32 years. It is further submitted that although the petitioner had possessed ten years of service experience along with H.S.C. qualification, his promotion to the post of Junior Clerk was not considered by the opposite parties. In view of such non-consideration of the candidature of the present petitioner, Original Application was filed before the OAT, Cuttack which has been transferred to this Court.

5. However, it appears that by the time of filing of O.A. in the year 2013, the petitioner was 54 year-old. So, the petitioner must have attained the age of superannuation by now. Consequently, the matter has become infructuous.

6.In view of the above, the WPC(OAC) is disposed of as infructuous.
