IN THE HIGH COURT OF ORISSA AT CUTTACK

WPC(OAC) No.4510 of 2012 Lambodara Biswal ....

Petitioner Mr. S.B.Biswal, Adv.

-versusState of Odisha & Ors.

....

Opposite Parties Mr.Karunakar Das, ASC

CORAM:

MR. JUSTICE S.K. PANIGRAHI

ORDER

17.02.2022 Order No.

06.

1. This matter is taken up by hybrid mode.

2. Heard learned counsel for the petitioner.

3. Learned counsel for the petitioner submits that the petitioner who was working as an In-charge Headmaster in a Govt. High School seeks to challenge the orders dated 03.09.2012 and 08.11.2012 at Annexures 4 and 5 by which he has been posted in a Jr. S.E.S. post notwithstanding the fact that many of his juniors in the Jr.S.E.S cadre have been continuing in Sr. S.E.S. cadre since 2006 and as such the action of the opposite parties smack arbitrariness.

4. Since this case is pertaining to year 2012, it has lost its relevancy.

Accordingly, the WPC(OAC) has become infructuous. However, liberty may be granted to the petitioner to approach this Court afresh, if any cause of action survives.

5. In view of the above, the WPC(OAC) is disposed of granting liberty as aforesaid.
