1. This matter is taken up through hybrid mode.

2. The petitioner has challenged the upper age limit prescribed in the advertisement dated 01.04.2011 issued by the opposite party No.2.

Learned counsel for the State submits that in response to the averments made in Paragraph-6(d) of the writ petition, it is submitted that the petitioner had applied under SEBC category for the post of Sepoys/Constables for the recruitment year, 2013 in O.S.A.P. 6th Battalion. As the age of the petitioner was over i.e. 28 years 5 months and 28 days as on 01.01.2013 being relaxed by 5 years under the SEBC category, the candidature of the petitioner was rejected due to overage and not selected in the post of Sepoys/Constables. His date of birth was 03.07.1984.

4. In such view of the matter, the case of the petitioner is devoid of any merit and hence the WPC (OAC) is dismissed. (S.K.Panigrahi) Judge
