This matter is taken up through Hybrid Mode.

Heard Mr. G.R. Sethi, learned counsel for the Petitioner and learned counsel for the State. 3.
The Petitioner has filed the present Writ Petition for the following relief:- "i) To direct the respondents to include the name of the applicant in the level-V gradation list.
ii) To direct the respondents to promote the applicant to the post of Level-IV.
iii) To quash Clause-6 &7 of the order dated 5.9.12 under Annexure-3.
iv) And pass such other order / orders as may be deemed fit and proper for the interest of justice". 4.
In spite of due service of notice, no counter affidavit has been filed. But taking into account the relief claimed in the present Writ Petition, no useful purpose will be served by keeping the matter pending here.

Accordingly, the Petitioner is permitted to make a detailed representation before opposite party No.1 within a period of three weeks from today hence.

It is observed that if such a representation is filed within the aforesaid period, the opposite party No.1 shall do well to take a lawful decision on the same on its own merit within a period of three months from the date of receipt of such representation. The order so passed by the opposite party No.1 be communicated to the Petitioner. 7.
With the aforesaid observation and direction, the Writ Petition (OAC) is disposed of.
