This matter is taken up through virtual/physical mode. 2.

The Original Application No. 4055 of 2013 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No. 4055 of 2013.

The Petitioner belonging to SEBC category, has participated in the selection test for the Post of Assistant Driver under the Police Motor Transport Department, Cuttack. It is the claim of the Petitioner that though, he had secured more marks than other candidates but his name did not find place in the select list.

Mr. Jayanta Kumar Bal, counsel for the Petitioner submitted that during the pendency of the matter, the Petitioner has been appointed as Assistant Driver and functioning as such.

In view of conceded position, this writ petition has become infructuous and no cause of action subsists. 6.

Accordingly, the writ petition is dismissed as infructuous.
