This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for both the parties.

The present writ petition has been filed by the petitioner seeking for a direction to the Opposite Parties to notify the D.P.C. held in the month of December, 2010 in the Keonjhar Education Circle for promotion to the Level-IV to Level-III in primary teacher cadre and the Petitioner may be granted all monetary and consequential service benefits. Although the Petitioner retired from service w.e.f. 31.01.2011, she has claimed notional promotion and consequential service benefits payable to her. In the meantime, more than a decade has passed and the Opposite Parties have not filed any counter affidavit in the matter.

Mr. S. Jena, learned counsel appearing for the School and Mass Education Department submits that he has no objection, if the
// 2 // Petitioner is permitted to file a fresh representation clearly stating her claims, which shall be considered by the competent authority within a stipulated period of time.

In such view of the matter, the writ petition is disposed of with a direction to the Petitioner to file a fresh representation indicating therein that the grounds upon which her claims are based and detailed calculation of monetary claim before the District Education Officer, Keonjhar along with certified copy of this order within two weeks from today. In the event such representation is filed by the Petitioner, the same shall be considered and disposed of the same in accordance with law by a speaking and a reasoned order within ten weeks from the date of filing. The decision so taken shall be communicated to the Petitioner within a period of ten days thereafter.

With the aforesaid observation, the writ petition is disposed of. 7.
Urgent certified copy of this order be granted on proper application.
