1.This matter is taken up by hybrid mode.

2. None appears for the petitioner at the time of call.

3. It appears that the petitioner has retired from Government service on 30.11.2000 while working as Chief Engineer, Rural Works, Odisha. On the date of his retirement a Departmental Proceeding was initiated against him. The second proceeding was initiated after five months. Though the Inquiring Officer has completed the inquiry as back as 2011, no final orders have been passed by the Government. Hence, the present petitioner has prayed for quashing of the proceedings seeking direction to the opposite parties to finalize the proceedings within the stipulated period.

4. But after abolition of the Tribunal, the case has been transferred to this Court. However, the cause of action as old as 2012. By efflux of time there seems to be absence of any cause of action in the present writ petition. However, liberty

// 2 // may be granted to the petitioner to approach this Court afresh, if any cause of action survives.

5. In view of the above, the WPC(T) is disposed of granting liberty as aforesaid.
