Heard Mr. A.K. Mohanty-A, learned counsel for the petitioner and Mr. B. Mohanty, learned Standing Counsel for School and Mass Education Department.

The petitioner has filed this writ petition seeking direction to the opposite parties to release the trained graduate scale of pay w.e.f. 13.12.1986.

In course of hearing, learned counsel for the petitioner states that the case of the petitioner is squarely covered by the judgment of this Court in the case of Madhab Chandra Podh v. State of Orissa, 1998 (II) OLR 334. Therefore, direction may be given to the opposite parties to consider the case of the petitioner in the light of the said judgment. 5.
Mr. B. Mohanty, learned Standing Counsel for School and Mass Education Department states that since similar question had come up for consideration before this Court in Madhab Chandra Podh v. State of Orissa & 4 others, 1998 (II) OLR 334, let the petitioner approach the authority by filing a fresh representation highlighting the grievance, which shall be considered in accordance with law.

As agreed to by learned counsel for the parties, however, without expressing any opinion on the merits of the case, this writ petition stands disposed of with the direction that in case the petitioner, with regard to the grievance made in this petition, files a fresh comprehensive representation before the authority concerned, within fifteen days hence, the said authority shall consider the same taking into consideration the judgment of this Court in the case of Madhab Chandra Podh v. State of Orissa & 4 others, 1998 (II) OLR 334 by passing a reasoned and speaking order, as expeditiously as possible, preferably within a period of three months from the date of receipt of such representation along with the certified copy of this order. Issue urgent certified copy as per rules.
