1.This matter is taken up by hybrid mode.

2. Heard learned counsel for the petitioners and learned counsel for the State.

3. The petitioner has approached before the Tribunal in the year 2012 challenging the inaction of the opposite party/authority by not giving appointment to the petitioner whereas the opposite party No.4 being placed at the rank below to him was appointed.

4. Though counter has already been filed, but by efflux of time since the cause of action raised in the instant petition does not seem to be surviving after nine years, the writ petition has become infructuous.

5. Accordingly the WPC(T) is disposed of.
