1. 1. This matter is taken up through Hybrid Mode. Order No

2. Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

3. The Petitioner has filed the present Writ Petition with the following prayer:- "(i) The respondents may kindly directed to regularize the period of servie from 24.1.2004 to 9.8.2009 by providing full salary and fixing revised scale of pay 2008 w.e.f 1.1.2006.

(ii) The salary for the period from 1.1.2004 to 23.1.2004 may kindly released with immediately effect.

(iii) After due proper calculation in respect of arrear amount for the aforesaid period may kindly be paid within a stipulated period.

(iv) And/or may kindly also grant any other relief and/or relief's which your Lordship think deem fit and proper for the benefit of the applicant.

4. Even though counter has been filed by Opp. Party No.4, but no reply to the same has been filed by the learned counsel for the petitioner.

5. In course of hearing, it came to the knowledge of this Court that the petitioner pursuant to the letter BEO, Malkanagiri

// 2 // issued on 6.05.2013 has not made any application seeking regularization of his period of service.

In view of specific stand taken by Opp. Party No.4 in his counter, Petitioner is directed to make a detailed representation before District Inspector of Schools, Malkangiri-Opp. Party No.4 (at present B.E.O, Malkangiri) by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three weeks hence.

It is observed that if such a representation is filed within the aforesaid period, District Inspector of Schools, Malkangiri-IOpp. Party No.4 (at present B.E.O, Malkangiri) shall do well to take a lawful decision within a period of three months from the date of receipt of such representation. The order so passed by the Opp. Party No.4 be communicated to the petitioner.

8. With the aforesaid observation and direction, the Writ Petition is disposed of.
