1. The matter is taken up through hybrid mode.

2. The petitioner seeks for issuance of direction to the respondentsopposite parties in connection with his promotion as per the D.P.C., which was held on 20.08.2001, who despite the recommendation of the opposite party No.3, without following the roster prepared by the gradation list, promoted the applicant from the post of Junior Assistant to Senior Assistant against the post of women (ST). Although the such post was available against the S.T. category, respondent No.4 who is belonging to SC category, was illegally promoted. In view of such anomaly in the gradation list, the petitioner approached the Tribunal, which has now been transferred to this Court.

3. In view of the fact that the O.A. was filed in 2013, the cause of action seems to have been extinguished by efflux of time. Hence, the WPC (OAPC) is disposed of as infructuous.

4. However, the petitioner is at liberty to approach the Court afresh, if any cause of action survives.
