1. Heard learned counsel for the Petitioner and the State.

2. By means of this application, the Petitioner seek grant of bail U/s.438 Cr.P.C. in apprehension of arrest for his alleged involvement in the offences U/s. 294/506/354 of IPC in connection with Khaira P.S. Case No.124 of 2010 corresponding to C.T. Case No.549 of 2010 pending in the court of learned JMFC, Soro.

3. Learned counsel for the state submitted that instruction could not be obtained. Hence, this Court is not inclined to grant anticipatory bail.

4. It appears from the record that the case is of the year 2010. Therefore, if process under Section 82 and 83 of Cr.P.C has not been initiated, in the event the Petitioner surrenders and moves for bail before the learned JMFC, Soro in the aforesaid G.R. Case within a period of three weeks hence and he shall be admitted to go on bail on such terms and conditions as would

// 2 // be deemed just and proper by the said court with further conditions that the Petitioner shall appear in person before the learned court below on each date of posting of the case.

5. The ABLAPL is disposed of accordingly.
