The matter is taken up through video conferencing mode. 2.

Heard Mr. S.S. Ray-2, learned counsel for the Petitioners and Mr. S.S. Mohapatra, learned Additional Standing Counsel. 3.

It is submitted that the name of Petitioner No.3 has inadvertently been mentioned as Binod Kumar Goude @ Bina instead of Binod Kumar Gouda @ Bina.

This is an application under Section 439 Cr.P.C. for grant of bail to the Petitioners, namely 1) Jitu @ Jitendra Pradhan, 2) Bulu Behera and 3) Binod Kumar Gouda @ Bina in connection with Badagada P.S. Case No.92 of 2021 corresponding to G.R. Case No.171 of 2021 pending in the court of learned J.M.F.C., Sorada for alleged commission of offence under Section 394 of the Indian Penal Code read with Section 25/27 of the Arms Act.

It is submitted that the Petitioners 1 and 2 are inside custody since 13th August, 2021 and Petitioner No.3 is inside custody since 27th September, 2021. It is further submitted that in the meantime investigation has been completed.

Mr. Mohapatra, learned Additional Standing Counsel submits that these Petitioners have criminal antecedents. 7.

However considering the period of detention of the Petitioners inside custody and the fact of completion of investigation as well as the nature of offences alleged, it is directed to release the Petitioners on bail in the aforesaid case on such terms and conditions to be fixed by learned court in seisin over the matter including the condition that, the Petitioners shall not be involved in any other offence while on bail and shall appear before the I.I.C. Badagada P.S. once in each week for a period of six months from the date of their release. 8.

The BLAPL is accordingly disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, in the manner prescribed vide Court's Notice No.514 dated 7th January, 2022.
