01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard Mr. Mallik, learned counsel for the Petitioner and Mr. Satapathy, learned Standing Counsel appearing for the Department.

3. The present writ Petition has been filed challenging the impugned show cause notice issued by the DEO, Jagatsinghpur vide memo No.4843 dtd.28.04.2017.

4. Since the writ Petition has been filed against the show cause issued by O.P. No. 3, this Court is not inclined to entertain the writ Petition. However, since it is submitted by learned counsel for the Petitioner that the Petitioner has already been filed his reply to the show-cause under Annexure-3, O.P. No. 3 is directed to take a lawful decision on the issue by giving a personal hearing to the Petitioner.

5. The entire exercise shall be completed within a period of three

(3) months from the date of receipt of this order. The Petitioner is

// 2 // directed to provide a copy of this order before O.P. No. 3 within a period of seven (7) days from the date of receipt of this order.

6. It is observed that till a decision is taken by O.P. No. 3 as directed by this Court, no coercive action shall be taken against the Petitioner.
