ORDER(Oral) 11.7.2022 03 1. This matter is taken up through hybrid mode.
2. On 8.4.2022, the matter was heard and considering in some detail and after hearing learned counsel for the parties, the following order was passed :
"2. The writ petition has been registered before this Court on 7th December, 2021 after the O.A. was transferred from the learned State Administrative Tribunal, Cuttack Bench, Cuttack upon its abolition.
3. On perusal of the order sheets available from the learned Tribunal, it is indicated that the matter was never taken up after 10.12.2014.
4. The O.A. was filed in the year 2013 challenging the order dated 30.01.2013 (Annexure-3) passed by opposite party no.2-Collector-cum-District Magistrate, Nuapada directing recovery of Rs. 6,38,600/- on instalment basis. By order dated 08.01.2014, interim order was passed to the effect that no recovery from the applicant/petitioner shall be made. The said interim order was also extended up to 10.12.2014, when the matter was last taken up and never taken up thereafter.
5. Learned counsel for the petitioner submits that the matter being old one, he has not been able to trace out the file and may be accommodated for some time.
6. As prayed for and to grant another opportunity to the petitioner, list on 5th May, 2022."
3. On 8.4.2022 further opportunity was granted to the petitioner and the matter was directed to be listed on 5.5.2022.
4. When the matter is called, none appears for the petitioner today and none had appeared on the last date, i.e., 5.5.2022.
5. Learned Standing Counsel reiterates his submissions on behalf of the O.Ps. as noted in the order dated 8.4.2022.
6. Having heard learned Standing Counsel for the State, the writ petition is dismissed for non-prosecution. (M.S.Sahoo) Judge dutta
