Mr. N. Biswal, learned counsel appearing on behalf of Mr. D.R. Pattanayak, learned counsel for the petitioner contended that the petitioner has been convicted in T.R. case, against which he preferred Cr.L.A. No.17 of 2008 before this Court and the same is still pending. Therefore, the petitioner may be permitted to withdraw the writ petition with a liberty to pursue his remedy after disposal of the aforesaid Cr.L.A. 3.

In view of the above, the writ petition is disposed of as withdrawn granting liberty as aforesaid.

Issue urgent certified copy as per rules.
