Sahadev Pradhan v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
WPC(OAC) No.3842 of 2011 Sahadev Pradhan ....
Petitioner Mr.B.Sahoo, Adv.
-versusState of Odisha & Ors.
....
Opposite Parties Mr.Karunakar Das, ASC
CORAM:
MR. JUSTICE S.K. PANIGRAHI
ORDER
15.02.2022 Order No.
01.
1. This matter is taken up by hybrid mode.
2. Learned counsel for the petitioner submits that the petitioner approached before the Tribunal in the year 2011 challenging the illegal action in not allowing the petitioner to appear in the physical Test for Combined Police Service Examination, 2011 after chest measurement made by examiner, though the petitioner qualified all the events and appeared in Viva-voice test for Combined Police Service Examination, 2009. But by efflux of time the WPC(OAC) has lost its relevance and cause of action raised therein does not seem to be surviving. Hence, the writ petition has become infructuous.
3. However, liberty may be granted to the petitioner to approach this Court afresh, if any cause of action survives.
4. In view of the above, the WPC(OAC) is disposed of granting liberty as aforesaid.
