This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.894 of 2020, on the files of learned S.D.J.M. Baripada, arising out of Baripada Town P.S. Case No.367 of 2020, under Sections 302/201/34 of IPC and is in custody since 06.06.2020.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge-cum-Presiding officer Special Court under POCSO Act, Mayurbhanj, Baripada, by order dated 16.10.2020 in the aforementioned case, the present BLAPL has been filed. 5.

On perusal of the 164 Cr.P.C. statement of witnesses Mita Kalandi, Rabishankar Kalandi and on consideration of Post Mortem

report, this Court is not inclined to entertain the BLAPL Application of the petitioner.

Accordingly, the same stands rejected.

It shall be open to the petitioner to move this Court at a later stage.

Since it is stated that the petitioner is in custody since 06.06.2020, learned Court in seisin over the matter may do well to expedite the trial.
