1. This matter is taken up through Video Conferencing mode.
2. Heard learned counsel for the Petitioners and learned Additional Standing Counsel for the State.
3. In this CRLMC under Section 482 of the Cr.P.C. the Petitioners have made a prayer to quash the F.I.R. dated 06.11.2021 bearing Chandrasekharpur P.S. Case No.455 of 20221 vis-à-vis the consequential criminal proceeding bearing C.T. Case No.6186 of 2021, pending in the court of the learned S.D.J.M., Bhubaneswar.
4. The case of prosecution, if brief, is that on 06.11.2021, the informant, namely, Arum Kumar Mohanty lodged a written report before the I.I.C., Chandrasekharpur Police Station alleging therein that he was in search of job and during course of such search, he found advertisement, namely, Subham Placement for Private Job in the facebook of petitioner no.1 in the month of April, 2021. Then the informant put his mobile no.9348321787 in the facebook. Thereafter, the petitioner no.1 contacted the informant and assured to give him job in
// 2 // Government Office within 17 days for which he had to pay a sum of Rs.50,000/-. The informant paid Rs.50,000/- to the petitioner no.1 and on 22.06.2021, an appointment order was sent through the mail of the informant. But, after some days, the petitioner no.1 told that the said appointment had been cancelled. Then another appointment letter was sent to the informant for the post of Block Co-ordinator at Mission Shakti, Odisha mentioning the reporting date as 22.11.2021 with Mission Shakti Stamp and Odisha Government Logo. The informant being suspected, contacted to Mission Shakti Office and came to know that the appointment letter was forged one and the petitioner no.1 had forged the document, Government Stamp and cheated him. Accordingly, the F.I.R. was registered under Section 420/ 468/ 471/ 34 of the I.P.C.
5. After arguing sometime, learned counsel for the Petitioners submits that the Petitioners may be permitted to withdraw this CRLMC with liberty to canvass all the contentions raised in this CRLMC on the basis of materials placed before this Court.
6. In such circumstances, this CRLMC is disposed of as withdrawn giving liberty to the Petitioners to raise all the contentions raised in this application on the basis of materials placed before this Court.
7. Accordingly, the CRLMC is disposed of.
8. As the restrictions due to resurgence of Covid-19 are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the Advocate concerned with his/her seal, in the manner prescribed vide
