1. The present contempt has been filed for the alleged disobedience of the order dated 16th August,2021 passed by this Court in W.P.(C) No.16669 of 2021.

2. Mr. Mohanty, learned Additional Standing Counsel appearing for the opposite party has produced letter no.3055 dated 15th November,2022 issued by the Tahasildar, Balianta addressed to the office of the Advocate General wherein after giving a detailed picture, it has been stated that the Sub-Collector, Bhubaneswar has already recommended the case of the petitioner bearing the Case No.2 of 2021 to the Collector and District Magistrate, Khordha vide letter dated 29th September,2022 for necessary approval for leasing out government land in favour of IDCO, Bhubaneswar for the purpose of establishment of Industries by the applicants like the petitioner.

3. The aforesaid letter dated 15.11.2022 along with annexures has been taken on record. Copy of the same supplied to the learned counsel for the petitioner.

4. Mr. Mohanty, learned Additional Standing Counsel further upon instructions from the Collector, Khordha states that the needful, in terms of the request made vide letter dated 29th September,2022 shall be done within four weeks from today.

In view of the aforesaid stand, learned counsel for the petitioner states that he has no objection, if the present contempt is disposed of.

5. In view of the above, the contempt is disposed of as infructuous.

The opposite party/Collector, Khordha shall be bound by their stand as made through their counsel before this Court.

It is clarified that in case of any discrepancy, the petitioner is free to seek the revival of the present contempt by making proper application.
