Heard Mr. P.N.Mohanty, learned counsel for the Petitioner and Mr. Prusty, learned Standing Counsel for the State- Opposite Parties.

The Petitioner has filed the present Writ Petition with the following prayer:- "(a) necessary direction be made to the Respondent No.3 to give promotion to the applicant from out of the Gradation List dated 24.07.2007 under Annexure-2 in terms of the order passed by the Hon'ble High Court of Orissa in W.P.(C) No.5588 of 2008 and the order dated 28.01.2011 and 14.2.2011 passed by the Inspector of Schools to prepare combined Gradation list of Ministerial staff taken over High Schools and old Government High Schools may be quashed and the same may not be given effect to.

(b) any other, order / orders or direction / directions be issued so as to give complete relief to the applicant".

Considering the submission made and without expressing any opinion on the merits of the case, the Petitioner is directed to make fresh representation before

// 2 // the Opposite Party No.2 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of two (2) weeks hence.

It is observed that if such a representation is filed within the aforesaid period, the Opposite Party No.2 shall do well to dispose of the representation in accordance with law within a period of 2 (two) months. The decision so taken by the Opposite Party No.2 be communicated to the Petitioner within that time. It is further observed that while considering the claim of the Petitioner, the order passed by this Court on 28.01.2011 and 14.02.2011 in W.P.(C) No.5588 of 2008 shall be taken into consideration, if it is applicable to the claim of the Petitioner.

With the aforesaid observations and directions, the Writ Petition is disposed of.
