Heard learned counsel for the parties.

The petitioners have filed this writ petition seeking direction to opposite parties 2 and 3 to implement the order dated 13.09.2022 passed in U.C.Case No. 5 of 2020 and to evict the illegal encroachment made by opposite party no.4 over the road in Plot No. 602 & 606 of Mouza-Nuapada in Cuttack Town.

In course of hearing, learned counsel for the petitioners states that highlighting the grievance, the petitioners have made a representation to the opposite party no.3 vide Annexure-4 and direction may be given to consider and dispose of the same within a stipulated time, to which learned counsel for the State has no objection.

As agreed to by learned counsel for the parties, this Court without expressing any opinion on the merits of the case, disposes of the writ petition directing the opposite party no.3 to take a decision on the representation filed by the petitioners vide Annexure-4 and pass appropriate order in accordance with law, within a period of six weeks from the date of production of certified copy of this order by the petitioners.
