This matter is taken up through hybrid mode.

None appears for the petitioner, when the matter is called. On 04.03.2022, none had appeared and after considering the matter in some detail and hearing learned counsel for the State, the following order was passed:- "The Original Application having been transferred from the learned Orissa Administrative Tribunal, Cuttack Bench, Cuttack upon its abolition, has been registered before this Court on 8.12.2021.

2. On perusal of the available order sheets of the learned Tribunal it is indicated that the matter was never taken up after 17.12.2013.

3. The O.A. was filed in the year 2013 by the petitioner who is the husband of a Government servant having expired on 26.11.2011 while working as Child Development Project Officer (CDPO), Athmallick.

4. Learned AGA relying on the instruction dated 20.2.2016 from the Sub-Collector, Balliguda (O.P. NO.4) submits that the provisional pension was sanctioned on 30.7.2014.

5. It is further submitted by learned AGA that since the process of sanction of pension had already started in the year 2011, in all likelihood the petitioner would have got the family pension thereafter.

6. To grant another opportunity to the petitioner, list on 30.3.2022."

Learned Standing Counsel reiterates the submissions on behalf of the opposite party-State as noted in the order dated 04.03.2022.

Accordingly, the writ petition is dismissed for nonprosecution. (M.S. Sahoo) Judge
