1. Heard learned counsel for the Petitioners and the State.
2. This is an application for bail U/s.438 Cr.P.C. filed by the Petitioners in anticipation of arrest for their alleged involvement in the offences U/s.147/148/332/353/294/506/342/431/427/435/307/ 338/337/269/270/188/149 IPC read with Sections 3 and 4 of the PDPP Act, Section 3 of the Epidemic Diseases Act and Section 51 of the Disaster Management Act.
3. The matter relates to the year 2020 and the co-accused persons in similar footing have since been released on bail in this case.
4. Keeping in view the nature of allegations, the circumstances appearing, the seriousness and gravity of the offences, while this Court is not inclined to grant anticipatory bail, it is directed that in the event the Petitioners surrender in connection with Tirtol P.S.
// 2 // Case No.212 of 2020 corresponding to G.R. Case No.206 of 2020 pending in the court of learned J.M.F.C., Tirtol within a period of two weeks' hence and move for bail, they shall be released on such terms and conditions as would be deemed just and proper by the said court with further conditions that they shall appear in person before the court below on each date of posting of the case unless specifically exempted by the court concerned.
