1. The matter is taken up through hybrid mode.

2. The grievance of the petitioner is that while he was working under the Administrative control of Horticulturist, Bargarh, a disciplinary proceeding was initiated against him vide order No.3/2473 dtd. 16.05.1996. The reason behind it being, the furnishing of false records of distribution of plant, fertilizer and B.H.C. to the beneficiaries and misappropriating cost amount to the tune of Rs.6,198.50 . The petitioner was directed to submit his defence arguments. In his defence he sought for quashing of the disciplinary proceeding and prayed for promotion.

3. Since the petitioner was 57 years old at the time of filing of the original application before the Tribunal, he must have retired by now. There seems no cause of action surviving by efflux of time. In view of such facts, the writ petition is disposed of as infructuous.

4. However, the petitioner is at liberty to approach the Court afresh, if any cause of action survives.
