08.03.2022 Order No.
2. This matter is taken up through hybrid mode. None appears for the petitioner when the matter is called. None had also appeared on 24.02.2022 for the petitioner and the following order was passed :- "The writ petition has been renumbered and registered before this Court on 08.12.2021 after being transferred, upon abolition of State Administrative Tribunal, Cuttack Bench, Cuttack.
On perusal of the available order-sheet of the learned Tribunal, it is found that the matter was never taken up after 09.04.2014.
The original application was filed in the year 2013 before the learned Tribunal by the petitioner challenging the rejection of the candidature of the petitioner as the constable in the selection process initiated by the State Selection Board, Orissa Police, Cuttack as per the advertisement in the year 2013. It is submitted by the learned Additional Government Advocate that the matter was never admitted by the learned Tribunal and given only a provisional number. To grant another opportunity to the petitioner, list on 03.03.2022."
// 2 // Learned Additional Government Advocate reiterates his submissions that nothing would survive for adjudication after lapse of nine years considering the fact that the challenge was to the selection process initiated in the year 2013. It is also submitted that the matter was never admitted and provisional number was only given by the learned Tribunal. The writ petition is dismissed for non-prosecution granting liberty to the petitioner to revive the same within 90 days for any surviving cause of action.
